Terms of service

1. Acceptable use

You may not post or publish any illegal, harmful, or objectionable content on the Sitepaste platform. We reserve the right to determine, at our sole discretion, what constitutes a violation of this policy. Users found in violation may have their accounts terminated immediately without prior notice.

These policies apply to all content hosted on our platform, regardless of whether you are using a Sitepaste subdomain or your own custom domain, and regardless of whether the content is public or password-protected.

The following content is strictly prohibited and will result in immediate account termination and reporting to appropriate authorities:

• Child sexual abuse material (CSAM) or any content that exploits or endangers minors. We are required by law to report such content to the National Center for Missing & Exploited Children (NCMEC) and law enforcement.
• Non-consensual intimate images or content depicting individuals without their consent
• Terrorism, violent extremism, or content that incites violence

The following content is also prohibited and may result in account suspension or termination:

• Selling illicit items or services
• Gang activity or promotion
• Malware, phishing pages, scams, or any content designed to deceive or harm users
• Harassment, doxxing, stalking, or targeted abuse of individuals
• Impersonation, fraud, or misrepresentation of identity
• Copyrighted material you do not have rights to distribute
• Sexually explicit or pornographic content, including nudity intended for sexual gratification
• Any content that is illegal within the United States
• Using the platform for political revolutionary purposes
• Publishing spam content or engaging in spam activities
• Any content or activity that we determine, in our sole discretion, to be harmful, objectionable, or inconsistent with the intended use of our platform

Password protection or other access restrictions do not exempt content from these policies. We may review any content in response to reports, legal process, or at our discretion to ensure compliance with these terms.

2. Age requirement

You must be at least 13 years of age to use this service. If you are between 13 and 18 years old, you must have parental or guardian consent to use the service.

3. Copyright and DMCA

We respect the intellectual property rights of others. If you believe that your copyrighted work has been copied in a way that constitutes copyright infringement and is accessible through our service, please submit a DMCA takedown notice to [email protected] including: (1) identification of the copyrighted work, (2) identification of the infringing material and its location, (3) your contact information, (4) a statement of good faith belief, (5) a statement of accuracy under penalty of perjury, and (6) your physical or electronic signature.

If your content was removed due to a DMCA notice and you believe it was removed in error, you may submit a counter-notification to the same address with: (1) identification of the removed material, (2) a statement under penalty of perjury that you have a good faith belief the material was removed by mistake, (3) your contact information, and (4) consent to jurisdiction and acceptance of service of process.

We will respond to valid DMCA takedown notices promptly. Users who repeatedly infringe copyrights will have their accounts terminated. We reserve the right to remove any content at our discretion, regardless of whether a formal DMCA notice has been received.

4. Service availability

While we strive for excellence, there are no guarantees of 24/7 resource perfection. Deployments may occasionally fail. We are not responsible for any downtime or deployment failures.

5. Payment and billing

All payments are processed by Launch With Lee LLC securely through Stripe. We do not store or have access to your payment information.

Failure to pay for your plan may result in your site being taken offline.

Plan pricing may change in the future. Any pricing changes will be communicated to you via your registered email address.

6. Usage limits

Maximum content sizes are enforced on all plans.

The platform may not be used as a cloud storage service alone. Anyone found to be using the platform primarily for storage or cloud services (rather than for publishing websites) will have their account terminated.

7. Content responsibility

We do not take responsibility for the content published on your site. You are solely responsible for all content you publish. We advise against publishing sensitive or personal information on your site.

8. Account termination

We reserve the right to suspend or terminate your account at any time, with or without notice, for any violation of these Terms of Service or for any other reason at our sole discretion.

You may cancel your account at any time. Upon termination, your right to use the service will immediately cease.

9. Law enforcement and legal compliance

We will cooperate with law enforcement agencies and comply with valid legal process, including subpoenas, court orders, and search warrants. We may preserve and disclose user information and content when we believe in good faith that such action is necessary to comply with the law, protect our rights or property, or ensure the safety of our users or the public.

As required by law, we will report any child sexual abuse material (CSAM) to the National Center for Missing & Exploited Children (NCMEC) and cooperate fully with any resulting investigation.

We may retain certain user data after account termination as required by law or as necessary to cooperate with legal investigations.

10. Reporting abuse

If you encounter content on our platform that you believe violates these Terms of Service or applicable law, please report it to [email protected]. Include as much detail as possible, including the URL of the content and a description of the violation.

We will review all reports and take appropriate action at our sole discretion. We are not obligated to notify you of the outcome of any report or investigation.

11. Modifications to terms

We reserve the right to modify or replace these Terms of Service at any time at our sole discretion. If we make material changes, we will notify you by email at the address associated with your account or by posting a notice on our platform.

Your continued use of the service after any such changes constitutes your acceptance of the new Terms of Service. It is your responsibility to review these terms periodically.

12. Disclaimer of warranties

The service is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement.

We do not warrant that the service will be uninterrupted, timely, secure, or error-free. We do not warrant that the results obtained from the use of the service will be accurate or reliable.

13. Limitation of liability

To the maximum extent permitted by applicable law, in no event shall Launch With Lee LLC, its officers, directors, employees, or agents be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from your access to or use of or inability to access or use the service.

Our total liability to you for all claims arising out of or relating to these terms or the service shall not exceed the amount you paid us in the twelve (12) months preceding the claim.

14. Indemnification

You agree to indemnify, defend, and hold harmless Launch With Lee LLC and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including reasonable attorney's fees, arising out of or in any way connected with your access to or use of the service, your violation of these terms, or your violation of any rights of another party.

15. Intellectual property

You retain all rights to the content you publish on your site. By using our service, you grant us a license to store, display, and distribute your content solely for the purpose of operating and providing the service.

The Sitepaste platform, including all software, code, designs, and trademarks, is owned by Launch With Lee LLC and is protected by copyright, trademark, and other intellectual property laws.

16. Governing law

These Terms of Service shall be governed by and construed in accordance with the laws of the United States and the state in which Launch With Lee LLC is incorporated, without regard to its conflict of law provisions. Any legal action or proceeding arising under these terms will be brought exclusively in the courts located in the United States.

17. Severability

If any provision of these Terms of Service is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary so that these terms will otherwise remain in full force and effect.

18. Entire agreement

These Terms of Service, along with our Privacy Policy, constitute the entire agreement between you and Launch With Lee LLC regarding the use of the service and supersede all prior agreements and understandings, whether written or oral.
